Information Concerning the Operation of the Owners' Association

  1. The Property is not subject to a right of first refusal or other restraint contained in the restrictions or restrictive covenants that restricts the owner's right to transfer the owner's property.
  2. The current regular assessment for the Property is $144.00 per year, billed as $72.00 on January 1 and July 1 of each year.
  3. No special assessment for the Property, due after the date the resale certificate was prepared, will be due.
  4. The total of all amounts currently due and unpaid to the Owners' Assocation that are attributable to the Property is $ dollars. The next dues assessment will occur on January 1 or July 1, whichever comes first. Note: If closing occurs after this date, please add $72.00 to the total amount due.
  5. No capital expenditures are approved by the Owners' Association for its current fiscal year.
  6. The amount of reserves for capital expenditures is $3000.00.
  7. There are no unsatified judgments against the Owners' Association that exist at this time.
  8. There are no suits pending against the Owners' Assocations at this time.
  9. The Owners' Association Board has knowledge of the following conditions on the Property which are in violation of the Bylaws and Covenants of the Owners' Association:

The Owners' Association has not received notice from any governmental authority regarding health or building code violations with respect to the Property or any common areas or common facilities owned or leased by the Owners' Assocation.   12. The Owners' Assocation administrative transfer fee is $50.00 and is payable to The Estates of Wellington Run Community Association.
  13. The Owners' Association is self-managed and does not use a managing agent.
  14. The restrictive bylaws and covenants do allow foreclosure of the Owners' Association's lien on the Property for failure to pay assessments.

Overview of Owner's Restrictive Covenants and Bylaws

The Estates of Wellington Run Community Association welcomes all new residents to the Community. To preserve the standard of living in the Community, certain Bylaws and Covenants were established by the original developers.

The following overview is provided to alert new homeowners to the requirements mandated by the Bylaws and Covenants of The Estates of Wellington Run and rulings by the Architectural Review Committee of the Owners' Association. The following list is not meant to be all inclusive, nor is it intended to supercede or negate the specific requirements of the aforementioned documents. Variances to Covenant restrictions may be available in selected circumstances. All variances must be approved by the Owners' Association Board of Directors.

___________ The Property may only be occupied by no more than three (3) adults. Any number of person(s) under the age of eighteen (18) may also live in the Property, as long as they are under the legal custody of one adult, or married couple, also living in the Property.
___________ The condition of the Property and Lot are to be maintained in good working order and in compliance with Community standards as defined by the Architectural Review Committee of the Owners' Association.
___________ The Property and Lot are to be free from debris and any such items deemed as unconventional, hazardous, or non-conforming to Community standards, as defined by the Architectural Review Committee of the Owners' Association.
___________ The Property must include a garage suitable for parking cars. Conversion of garage areas to living quarters is not permitted.
___________ Modifications to exterior colors and materials of the residence and/or changes to landscaping, fences, sheds, trees, etc. must be approved by the Architectural Review Committee of the Owners' Association.
___________ Outside, decorative items, such as flagpoles, fountains, wind mills, picket fences, etc. and non-decorative items, such as large antennas are not permitted. Holiday decorations are permitted, during a reasonable time period around the respective holiday.
___________ All owners are required to pay dues and assessments. Unpaid dues and assessments will be fined at the rate of 20% per year. Liens for unpaid dues and assessments may be issued against the Property, as deemed proper by the Board of Directors of the Owners' Association.
